Privacy Policy

In short: We collect very little: your uploaded audio is processed briefly and then deleted, we don't sell anything, and the only third parties on this site are Google Analytics, Google AdSense, and Cloudflare Turnstile (for the contact form).  Details follow below.

1. About WhatsMyBitrate

WhatsMyBitrate.com (the "Services") is a free audio analysis tool built and operated by Oren Cohen. In this Privacy Policy, "we," "us," and "our" refer to the operator of whatsmybitrate.com, who acts as the data controller for personal data collected through the Services. By using the Services, you acknowledge that you have read and understood this Privacy Policy.

2. Our Approach

Our goal is to collect as little information as possible and to process your audio files only for as long as it takes to deliver the analysis you requested. The analysis source code is public on GitHub, so the file-handling behavior described here can be independently reviewed rather than taken on faith.

3. Information We Collect

Audio files you submit. When you upload a file, it is transmitted to our server and held only for as long as it takes to complete the requested analysis  reading its metadata, decoding the audio, measuring frequency content, and, if selected, rendering a spectrogram. The maximum upload size is 100MB, and supported formats currently include MP3, AAC, M4A, WAV, FLAC, AIFF, and OGG/Vorbis. Once analysis is complete, the file is deleted from our systems. We do not keep copies of submitted files, and we do not sell, license, or otherwise share them with any third party. The results and spectrogram displayed to you exist only for your current session and are not stored on our servers afterward.

Information you provide to us. If you send a message through the contact form, we collect whatever you include (typically your name, email address, and message) solely to respond to you. Contact submissions are not used for marketing and are not added to any mailing list.

Device and usage information. We use Google Analytics (measurement ID G-8V59RSJG62) to understand how visitors use the Services  for example, pages visited, session length, approximate location, browser and device type, and referring pages. This never includes the contents of your audio files.

Cookies. Cookies on this site come only from the third-party services named in this Policy: Google Analytics, Google AdSense, and Cloudflare Turnstile (which protects the contact form from automated abuse). We do not set separate first-party tracking cookies of our own. See our Cookie Policy for a full breakdown by category.

4. How We Share Information

We do not sell your personal information. We share information only:

●       With the service providers named above (Google Analytics, Google AdSense, Cloudflare Turnstile), each of which processes information under its own privacy policy;

●       Where we believe in good faith it is necessary to comply with the law, legal process, or a governmental request, or to protect the rights, property, or safety of WhatsMyBitrate, its users, or the public; and

●       If the Services are acquired or transferred, in which case information may transfer to the new operator subject to the commitments in this Policy.

5. Advertising

The Services display advertising served through Google AdSense (publisher ID ca-pub-7661783991682313). Google and its advertising partners may use cookies or similar technology to show ads based on your prior visits to this or other sites.

You can opt out of personalized advertising at any time through Google's Ads Settings (adssettings.google.com). Opting out means you will still see ads, but they will be less tailored to you. California residents also have specific rights described in Section 10 below.

6. Security and Data Retention

We use reasonable technical safeguards, including encrypted transmission (HTTPS), but no method of transmission or storage over the internet can be guaranteed to be completely secure. Uploaded audio files are retained only for the time needed to complete your requested analysis and are then permanently deleted. Contact-form messages are kept only as long as needed to address your inquiry. Data collected by Google Analytics and Google AdSense is retained according to Google's own policies.

7. Children's Privacy

The Services are intended for a general audience and are not directed at children. We do not knowingly collect personal information from children under 13 (or the relevant minimum age in your jurisdiction) without appropriate consent. If you believe a child has provided us with personal information, please contact us so we can address it.

8. International Data Processing

Because our servers and service providers may be located outside your own country, including in the United States, your information may be processed there. By using the Services, you consent to this processing as described in this Policy.

9. Your Privacy Rights  EEA, UK, and Switzerland

If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have rights under applicable data protection law, including the right to access, correct, or delete your personal data, to restrict or object to certain processing, and to data portability. Because uploaded files are deleted immediately after analysis and we maintain no user accounts, we typically hold very little personal data about any individual visitor. We rely on performing our Services (processing files you submit) and, in limited cases, our legitimate interests (such as keeping the Services secure) as our legal bases for processing, and on consent where required by law. You may exercise your rights, or lodge a complaint with your local data protection authority, by contacting us through the Contact page.

10. Your California Privacy Rights

California residents have rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA), including the right to know what personal information we collect and to request its deletion, subject to certain exceptions. We do not sell personal information for money. However, the advertising cookies used through Google AdSense may be considered a "sale" or "sharing" of personal information under the CCPA's broad definitions. You can opt out by enabling the Global Privacy Control (GPC) signal in your browser, which we honor, or by adjusting your browser or ad-blocking settings. We will not discriminate against you for exercising any CCPA right.

11. Other Important Information

This Policy applies only to whatsmybitrate.com and does not cover third-party sites we may link to, including findgenre.com or our GitHub repository, each of which has its own policies.

12. Changes to This Policy

We may update this Policy from time to time. Material changes will be highlighted here with a revised "Last updated" date before they take effect.
